貴陽高新技術產業開發區條例

(2010年12月30日貴陽市第十二屆人民代表大會常務委員會第二十九次會議通過 2011年3月30日貴州省第十一屆人民代表大會常務委員會第二十一次會議批準)

 

  第一條 為了促進貴陽國家高新技術產業開發區(以下簡稱高新區)的建設和發展,規范高新區管理和服務,根據國家有關法律、法規的規定,結合本市實際,制定本條例。

  第二條 在高新區從事高新技術產業以及與高新技術產業相關的活動,應當遵守本條例。 
  本條例所稱高新區,是指經國務院批準設立,發展高新技術產業的區域,包括金陽科技產業園、貴陽高新技術生態產業經濟帶、新天高新技術工業園以及市人民政府確定的其他區域。 

  第三條 市人民政府應當將高新區的建設和發展,納入本市國民經濟和社會發展規劃、城市總體規劃和土地利用總體規劃。 
  市人民政府應當設立高新技術產業發展專項資金,用于高新技術產業發展、科技型中小企業技術創新、創業投資引導、孵化、培育高新技術企業。 
  
    第四條 貴陽國家高新技術產業開發區管理委員會(以下簡稱高新區管委會) 是市人民政府的派出機構,按照市人民政府授予的職權,在高新區內行使市級經濟管理和行政管理權限,履行下列職責: 
 ?。ㄒ唬┕岢構?、省、市實施高新技術產業發展的法律、法規和各項方針政策,制定和實施高新區各項管理制度和規定,建立完善服務體系,創造和維護良好的投資環境; 
 ?。ǘ└莨笱羰諧鞘兇芴騫婊?,會同城鄉規劃主管部門組織編制高新區詳細規劃,編制高新區產業發展規劃,經批準后組織實施; 
 ?。ㄈ┳櫓凳└咝慮淖酆嚇涮贅母?,指導高新區內企業建立適應社會主義市場經濟和高新技術產業發展要求的現代企業制度、勞動人事制度、分配制度,培育發展各類市場和社會中介組織; 
 ?。ㄋ模┩吵?、協調、管理高新區的經濟技術協作和招商引資; 
 ?。ㄎ澹┏邪焓腥嗣裾話斕鈉淥孿?。 

  第五條 市人民政府有關部門和有關區、縣人民政府應當支持、協助高新區管委會做好管理和服務工作。 
  高新區管委會應當支持高新區所在地有關區、縣發展經濟,形成相互促進的合作機制。 

  第六條 高新區應當建立精簡高效的管理體制。 
  鼓勵和支持高新區改革、創新人事管理制度,建立多種形式的用人機制和分配激勵機制。
 
  第七條 市人才資源開發資金應當優先用于高新區的人才培養和引進。對高新區引進的高層次人才,市人民政府有關部門應當按照本市引進人才的有關規定優先辦理聘用、錄用、戶籍等有關手續。 

  第八條 高新區內的建設用地,由高新區管委會根據市人民政府授權,依據土地利用總體規劃和年度計劃,實行統一征收、開發、出讓、管理。 
  高新區應當節約集約利用土地,提高單位土地面積的投資強度和產出效率。 
  高新區的土地收益留存部分用于高新區的土地開發、基礎設施建設和改善投資環境。 

  第九條 根據高新區發展需要,工商、稅務等相關部門,可以在高新區內設立派出機構或者分支機構,依法為企業和其他市場主體提供服務。 

  第十條 高新區應當按照國家確定的高新技術領域,結合本地實際,重點發展新材料、新能源、航空航天、先進制造、電子信息、生物醫藥等高新技術產業,并且根據經濟、社會發展需要和國家產業政策,適時調整產業發展方向。 
  鼓勵和支持金融、現代物流、服務外包、網絡信息、創意設計等現代服務業以及為高新技術產業服務的其他產業的發展。 

  第十一條 鼓勵和支持企業、其他組織和個人,在高新區投資興辦高新技術企業,設立研究開發機構或者地區總部。 
  高新區的高新技術企業,享受國家、省、市以及高新區的有關優惠政策。
 
  第十二條 市人民政府應當支持高新區完善高新技術產業扶持政策,優化發展環境。市技術改造資金和應用技術研究與開發資金應當重點保障高新區的技術改造和高新技術應用研究與開發。
 
  第十三條 加強對高新區項目的扶持,高新區內獲得國家、省、市資金扶持的項目,高新區按照相應比例予以資金匹配。 

  第十四條 鼓勵和支持企業、高等院校、科研機構以及個人在高新區從事技術創新項目的研究、開發,進行專利申請、商標注冊、軟件著作權登記。對取得自主知識產權并且在高新區實施產業化的機構和個人予以扶持。 

  第十五條 高新區設立專項資金,支持企業、高等院校、科研機構以及其他組織在高新區興辦綜合孵化器或者各類專業孵化器。經認定的孵化器,享受國家、省、市和高新區的有關優惠政策。 

  第十六條 高新區應當加強留學歸國人員創業園、大學生創業園等特色園區建設。 
  鼓勵、扶持留學歸國人員、大學畢業生及其他人才在高新區創業。 

  第十七條 鼓勵符合執業資格條件的組織和個人依法在高新區設立各類中介服務機構,經認定為高新技術產業服務的中介服務機構,可以享受高新區的有關優惠政策。 

  第十八條 鼓勵各種投資主體在高新區開展風險投資活動,設立風險投資機構。 
  風險投資機構可以通過企業并購、股權回購、證券市場上市等方式回收其風險投資。
 
  第十九條 高新區內的企業應當按照環境?;?、安全生產、勞動?;?、職業衛生等方面的規定,優化生產環境,加強安全生產管理,創造良好的勞動條件。 

  第二十條 高新區應當建立完善招商引資激勵機制,對在招商引資工作中做出顯著成績的組織和個人予以獎勵。 

  第二十一條 高新區管委會應當對高新區內需申報認定高新技術的企業提供服務,協助企業申辦有關手續。 

  第二十二條 高新區管委會應當公開有關優惠政策、辦事項目、程序、時限、服務承諾以及其他依法應當公開的政務信息,為高新區內的組織和個人提供優質、高效、便捷的服務。 

  第二十三條 高新區行政事業性收費的項目、范圍、標準應當公布。 
  除國家和省人民政府規定的收費外,任何單位不得向高新區內的企業和其他市場主體收取費用。 

  第二十四條 除依法進行以及省、市人民政府明確規定的檢查外,任何單位和組織不得擅自入區檢查。實施檢查不得干擾、妨礙被檢查單位正常的生產經營秩序。 

  第二十五條 對違反本條例第二十三條規定的收費、第二十四條規定的檢查,高新區的企業和其他市場主體有權拒絕,并且有權對侵犯其合法權益的行為向高新區管委會投訴。 
  高新區管委會對屬于職權范圍內的投訴事項,應當自接到投訴之日起10日內進行處理;屬于市人民政府有關部門職權范圍的,應當在3日內移送有關部門處理,有關部門應當在接到移送投訴之日起10日內進行處理。處理結果應當書面告知投訴人。 

  第二十六條 高新區管委會、有關行政部門及其工作人員,有下列情形之一,尚不構成犯罪的,由有關機關依法給予行政處分: 
 ?。ㄒ唬┎灰婪ü裥畔⒑捅咎趵娑ǖ撓泄厥孿畹?; 
 ?。ǘ┎灰婪男兄霸?,或者濫用職權,損害企業、其他市場主體合法權益的; 
 ?。ㄈ├彌叭ㄡ咚轎璞?,謀取非法利益的; 
 ?。ㄋ模┢淥シㄐ惺怪叭ǖ男形?。 

  第二十七條 市人民政府應當依據本條例規定,適時制定公布有關優惠、扶持、獎勵的具體辦法。

REGULATIONS FOR GUIYANG NEW AND HIGH-TECH INDUSTRIAL DEVELOPMENT ZONE

  Adopted at the 29th Session of the Standing Committee of the 12th People’s Congress of Guiyang 

  Approved at the 21st Session of the Standing Committee of the 11th People’s Congress of Guizhou Province

    Article 1 In the light of the relevant laws, regulations and policies of the State and the City, the regulations are formulated with aims to promote the construction and development of Guiyang National New and High-tech Industrial Development Zone (hereinafter referred to as "High-tech Zone") and to standardize the management and service of High-tech Zone.

  Article 2 The regulations shall be abided by any enterprise engaged in new and high-tech industries and related activities in High-tech Zone.

  Under the approval of the State Council of China, the High-Tech Zone herein was established, referring to the new and high-tech industrial development areas, including Jinyang Science and Technology Industrial Park, Guiyang New and High-tech eco-industrial Economic Zone, Xintian New and High-tech Industrial Park and other areas confirmed by the People’s Government of Guiyang(hereinafter referred to as "the City Government".

  Article 3 The City Government shall incorporate the construction and development of High-tech Zone into the national economic and social development program, the urban overall plan and the general plan for land use.

  The City Government shall allocate special funds of the new and high-tech industrial development for the development of new and high-tech industries, the technology innovation of science and technology-oriented small and medium-sized enterprises, and the new and high-tech enterprises guided and incubated by venture capital.

  Article 4 Guiyang National New and High-Tech Industrial Development Zone Administration Commission (hereinafter referred to as "High-tech Zone Commission"), a branch organ of the City Government, was granted the city level jurisdiction for economic management and administrative management in High-tech Zone, and it performs the following duties:

  (1)Implement the State’s, the Province’s and the City’s laws, regulations, policies and principles concerning the new and high-tech industrial development, formulate and carry out the management systems and stipulations related to High-tech Zone, set up and optimize service system, create and safeguard sound investment environment;

  (2)In the light of Guiyang’s overall plan, coupled with the detailed plan of High-tech Zone organized by the competent department of city and country planning, formulate the development plan of the industries in High-tech Zone, and organize the implementation after approval;

  (3)Organize the implementation of the comprehensive reforms of High-tech Zone, guide the enterprises in High-tech Zone to establish modern enterprise system, labour and personnel system, and distribution system, foster and develop various market and social intermediary organization;

  (4)Make an overall plan to coordinate and manage the economy and technology cooperation and trade and investment promotion of High-tech Zone;

  (5)Undertake and handle other matters required by the City Government.

  Article 5 The related departments of the City Government, and the related district and county people’s government shall support and help High-tech Commission to provide good management and service.

  High-tech Commission shall support the related districts and counties located in High-tech Zone to develop economy and form a cooperative mechanism to promote each other.

  Article 6 High-tech Zone shall build up an simplified and efficient administrative system.

  Encourage and support reforms of High-tech Zone, innovate personnel management system, establish various employing mechanisms and incentive mechanisms for distribution.

  Article 7 The capital of the City’s talent resources development shall be first used for introducing and training the talent people in High-tech Zone. In accordance with the regulations relevant to the city’s introduction of talents, the high-level talents introduced by High-tech Zone have priority to be employed, and the related departments of the City Government shall first handle procedures concerning talents’ employment, household registration and so on.

  Article 8 In accordance with the overall plan and the annual plan for the land utilization, authorized by the City Government, High-tech Zone Commission exercises unified acquisition, exploitation, cession and management on the construction land in High-tech Zone.

  High-tech Zone shall economize land use and realize the intensiveness of land use, improve the investment intensity and production efficiency per unit of land.

  The retained land earnings of High-tech Zone shall be partly used for land exploitation, construction of infrastructural facilities and improvement of investment environment of High-tech Zone.

  Article 9 In light of the needs of High-tech Zone’s development, some relevant departments, such as industry and commerce and revenue, etc., may set up their agencies and branches in High-tech Zone to serve the enterprises and other market entities in accordance with laws.

  Article 10 In accordance with the actual conditions, High-tech Zone shall focus on the development of the new and high-tech industries among the new and high-tech fields confirmed by the State, such as new materials, new energy, aerospace, advanced manufacture, electronic information, biological medicine, etc., and timely adjust the direction of the industrial development according to the needs of the economic and social development and the State’s industrial policies.

  Encourage and support the development of the modern service industry, such as finance, modern logistics, service outsourcing, network information, creative design, etc, and the other industries serving for new and high-tech industries.

  Article 11 Encourage and support enterprises, other organizations and inPiduals to invest and establish new and high-tech enterprises or R&D institutions or regional headquarters in High-tech Zone.

  The new and high-tech enterprises in High-tech Zone enjoy the relative preferential policies of the State, the Province, the City and High-tech Zone.

  Article 12 The City Government shall support High-tech Zone to perfect the policies of supporting the new and high-tech industries, and optimize the environment for development. The city’s capital of technical reforms and R&D on applied technology shall be focused on the guarantee of the technical reform and the new and high-tech’s application research and development of High-tech Zone.

  Article 13 Reinforce the support to the projects of High-tech Zone. High-tech Zone provides the corresponding proportion of supportive funds for those projects financed by the State, the Province or the City.

  Article 14 Encourage and support the enterprises, colleges and universities, institutions for scientific research, and inPiduals, in High-tech Zone, to be engaged in the researches and exploitations of technology innovation projects, and the related patent application, trademark registration and software copyright registration. Support those institutions or inPiduals who possess intellectual property rights and put them into industrialization in High-tech Zone.

  Article15 High-tech Zone establishes special funds to support enterprises, colleges and universities, institutions for scientific research, and other organizations, in High-tech Zone, to start comprehensive incubators or various professional incubators. The approved incubators enjoy the relative preferential policies from the state, the province, the city and High-tech Zone.

  Article 16 High-tech Zone shall intensify the establishment of characteristic parks, such as the business incubators for returned overseas Chinese and for college students.

  Encourage and support returned overseas Chinese, the graduates, and other talents start business in High-tech Zone.

  Article 17 Encourage qualified organizations and inPiduals to set up kinds of intermediary service agencies in High-tech Zone in accordance with laws. The recognized intermediary service agencies serving for new and high-tech industries can enjoy the relative preferential policies from High-tech Zone.

  Article 18 Encourage various investors carry out risk investment and set up institutions for venture capital in High-tech Zone.

  Institutions for venture capital can recoup their risk investment through ways, such as enterprises merger and acquisition, share buybacks, being listed on stock market and so on.

  Article 19 Enterprises in High-tech Zone shall optimize production environment, reinforce safe production management, and create favorable working conditions in accordance with the provisions covering areas such as environment protection, safe production,   labour protection and occupational hygiene.

  Article 20 High-tech Zone shall establish and perfect the stimulation mechanism of trade and investment promotion. Organizations and inPiduals who make outstanding achievements in the course of trade and investment promotion shall be awarded.

  Article 21 High-tech Commission shall provide service for the enterprises, in High-tech Zone, who apply for recognition of high-tech enterprise, and help them go through the relative formalities.

  Article 22 High-tech Commission shall make public the relative preferential policies, projects, procedures, time frames, service promises and other government affairs which should be released in public in accordance with laws, and provide service with excellent quality and high efficiency and good  convenience for organizations and inPiduals in High-tech Zone.

  Article 23 The projects of the administrative and utilities charges, the scopes and standards shall be made public.

  No unit may charge fees from the enterprises and other market entities in High-tech Zone, except for those charges stipulated by the State and the people’s government of the province.

  Article 24 Any unit or organization shall not inspect High-tech Zone without authorization, except for the inspections clearly stipulated by the people’s government of the city or the province in accordance with laws. Any inspection shall not affect the normal production and business operation activities of the examinee entities.

  Article 25 With respect to the charges in violation of Article 23 of the Regulations and the inspections in violation of Article 24 of the Regulations, enterprises and other market entities in High-tech Zone have the right to refuse, and to complain to High-tech Zone Commission about the conducts violating their legitimate rights.

  High-tech Zone Commission shall, within 10 days of receiving the complaint, conduct the settlement to the complaint within the its authority; the complaint within the authority of the relative departments of City Government’s shall be transferred to the departments concerned, and be processed within 10 days of receiving the complaint transferred. The result of the complaint shall be delivered to the complainant in writing.

  Article 26 High-tech Zone Commission, the administrative department concerned and their staffs who commit any of the following acts, if no crime is constituted, shall be given administrative sanctions by the relative departments in accordance with laws. 

  (1)Not making public the government affairs and matters related to the Regulations herein.

  (2)Not performing their duties, or abusing their power, causing damage to the legal rights and interests of enterprises and other market entities;

  (3)Abusing power to engage in self-seeking misconduct and seek illegal rights and interests;

  (4)Exercising other illegal authority.

  Article 27 In accordance with the regulations herein, the City Government shall timely formulate and publish the concrete ways to provide preference, support and rewards.
